The "law" really doesn't mean a thing on its own. It is how it is interpreted. Then that becomes precedent. Future cases rely on precedent to determine the outcome, or to allow/disallow evidence to be presented, or to give instructions to a jury.

… and that's what it's all about.

Now, please read before re-posting the LAW because the LAW is un-useable in this situation that has been approved by the state authorities.

Call it a Catch-22 situation - just post your OWN thoughts about the subject.

Now, STORAGE of a weapon during non-hunting situations, the Law would apply better, but still not perfeect.


The law is fairly specific. Chapter 97B sets forth the criteria under which children may possess firearms for the purpose of hunting. I understand your point, and here's my opinion. If a child is NOT hunting and has access to a loaded firearm then 609.666 will come into play.

Who is responsible when the "legal" child leaves a loaded firearm around? Three possibilities: The child, the parent, or the owner of the firearm. Theoretically, all three could be charged, although that wouldn't be likely.

I'm glad the law is clear. It would be a shame for a 17 year old to have access to firearms. Wait, I was 17 when I joined the Army, they trusted me with full auto machineguns, hand grenades, crewing a 30 ton infantry fighting vehicle...

I'm sure there were several layers of supervision. Your squad leader, your platoon sgt, Platoon Commander.... :lol:

It is so sad to hear of accidents like this. I can only imagine what the parents of both children must be going through. Best wishes to all involved...

As someone who knows the family of the boy who was killed, I can report that they are quite traumatized by this.
