NICS check delayed for Ruger 10/22

Have you guys run into this before? Not cancelled, nor denied, but delayed. What can I expect to happen?

I've been delayed a few times, no big deal. Resolves itself in a few days. If it's through Gouger I recommend calling them to check if the hold has been lifted rather than waiting for them to call you.

Sometimes the NICS folks are busy when the retailer calls in. It happens. There is a time frame in which NICS is supposed to tell the shop whether it's approved or denied after a delay, but I don't remember if it's 24 hours or some other period. The shop should have taken your phone number to call you with an update.

Well when I don't give my social I can sometimes get delayed because another person with my name. So now I use my social and its quicker. At least from my experience.

If you don't get an answer either way, it becomes an approve after 5 days automatically.

Some companies like scheels treat it as a deny though and won't sell you the gun. Just company policy for them

That's strange considering the ATF specifically says to complete the transaction if no reply is received.

If a firearms retailer does not get a response back within three business days you can pick up your firearm. The three days do not include Sat, Sun or Federal holidays.

My NICS a few years back came back "delayed" for a Saiga. I won't mention what shop it was through, but they let me take the rifle anyhow. I can only assume they got the good answer sometime after that. :)

They stuck my dad with a '24hr delay,' the night before deer opener.
He was picking up a .410 single shot for my brother to use the next morning...
Even a 13 years of age I was able to call BS on that one.

I've got a friend who gets the 'delay' every time.

Personally, I've never been delayed, but then again I haven't purchased from an FFL since the current regime took the wheel.

I’ve never been delayed and don't provide my SSN. Guess I should consider myself lucky.....and have purchased from several different dealers.

Not to pick on another dealer, but they should have explained the process to you.

It's sometimes the fact that someone with the same name or similar name has
some criminal history, and sometimes the buyer has criminal history that needs to be
checked to verify that they are not prohibited from purchasing a firearm. Usually within a day we get a call
and are told we can proceed. Often we're told while we're doing another NICS check on a different buyer.

The time frame is actually this - If no response is received from the NICS center, we MAY
transfer the firearm on XXX date ( the date is always provided by the NICS examiner, and it is always
AFTER 3 FULL business days have passed. So if you get delayed on a Wed. and no response is received,
we may not transfer the firearm until Tuesday of the following week (provided there is no holiday). That rarely happens, but it does.

There are a couple stores that will not transfer the firearm without a Proceed from the NICS call center.
That's up to them. They are not required to do the transfer. They are only allowed by law to do it.
