permit to purchase question

Postby Minnesotalean on Sun May 20, 2012 3:37 am

If I pay for a gun and don't have a permit can I have someone with a permit pick it up and are the guns registered when purchased?

Why do you ask? Have you been denied a permit?

Guns are registered to the buyer when purchased. A second "pickup" person is a straw buyer, and illegal.

I'm confused. Is this from a FFL or private sale.

I think tmans question should be answered before we give all of our input. ;)

There is no registration in MN but I do agree. Let's get the answer to tmans question.

Good point. I should have asked for clarification first. I'm an FFL, so always err on the side of caution. :D

If buying from an FFL, my original post is mostly correct. MN doesn't register, but the FBI does, and what you describe is a straw purchase, and illegal. Any FFL should deny the transfer if they know you are doing this.

Private party is more lax. Most people ask for a PTP or PTC and bill of sale to protect themselves. But I don't believe it is required. If its private party, you can have anyone pick it up, technically.

The FBI does not operate a registry - what registry are you talking about?

The fbi doesn't register. You keep the forms on file but the fbi doesn't get a list of what guns you bought where. The nics check doesn't include any serial number.

You really an ffl telling people that there is gun registration?

All NICS calls are over the phone or on the Internet, it's safe to presume the NSA records all information.

They know a check was made but no gun information is given during the call

Neither Minnesota or the Fed Gov. have a registry of firearms but a firearm can be traced to the last 4473 performed on a particular gun.

It would be illegal for any agency to keep NICS information for more than 24 hours. At least that is how I understand it, but I would not be suprised if they were breaking their own laws, seems like that is the governments favorite thing to do these days.
