Well, not if you smoke a cyclist or pedestrian. The rules are screwed up enough where they can just end up getting a ticket. At least that happened here in AZ, and I'm pretty sure it's happened in MN. Out here some cyclist got run over and killed by a lady in an SUV that drifted into the bike lane, and all she got was a $420 fine.
That really sucks.
