My uncle from down in Iowa has a pistol that he wants to sell me. Could i just go down there and pay him for it and drive it back to the great state of MN? or do i neeeeeeed to go through an FFL?

Question? If guns are not registered, who is to know? If he buys it, takes it home, sells it years later? How would he be found guilty of buying it across state lines? Who would know and how would they know?

yes, i have wondered that as well. I mean i'm not trying to do anything illegal and i wouldn't want to put my uncle up to something the would feel uncomfortable with either.

He lives in Des Moines. I haven't seen him in a while so i was also trying to use this as another reason to head down there the next free weekend.

If the gun is ever lost or stolen and later turns up (or if ever used for self defense) they will do a trace on the gun. A trace follows the chain of ownership from the factory. They will most likely see that it jumped the border without an FFL transfer and both individuals will have some 'splainin to do.

It's the law and it's best to go through an FFL.

However, the only trace from the factory to the FFL ends with the retail sale unless it goes through an FFL on a subsequent sale. Any personal sales, trades, inheritance or gifts are not recorded in any way, short of running it through an FFL. There are a number legitimate ways handguns jump state lines without FFL transfer including either the buyer or seller moving while in possession of the gun. I believe there are a number of others including inheritance but I would have to do the research.

In reality transfers like this happen all the time. A very high percentage of people don't even know it's illegal and just sell or trade guns with friends. Short of some nefarious intent and action, I've never heard of prosecutions for these sort of transfers.

That said, the safest, and legal, way to transfer is by FFL.

I won't disagree with doing the transfer by the book, but I wonder: would any secondary or tertiary FFL transfers, not sequential, or related to the original chain of custody, or the original sale FFL be discovered? If so, how?
