Gun Show etiquette in Minnesota

Postby fuller malarkey on Sat Nov 17, 2012 4:12 pm

Going to a show tomorrow in Pipestone, put on by the local Chamber, not a circuit outfit. [You know, professional promoter]
Never been to a Minnesota gun show, and am wondering what is permissible by attendees? Like, can I bring items I'd like to sell or trade? Can one tape a for sale sign with asking price on a long gun's barrel, shoulder sling it and wander the aisles? I'm up to snuff on federal requirements, not at all familiar with what restrictions the state here might have.

Any do's or don'ts that aren't based in personal bias would be gratefully received. I understand handguns require a permission slip, anything else? In other states, I'd get a copy of an ID and a statement that the buyer isn't a prohibited person from a potential buyer / trader. I have Bill of Sale's pre-prep'd. Several copies of my own ID. What else should someone bent on wheelin' and dealin' know or have? Cash. Yes. I know about that.

State law only requires that you not knowingly sell to a prohibited purchaser. You are not required to verify that they have a PTC or PTP or even to view ID if you choose not to do that. Personally, I use a Bill of Sale, require ID, and want to see a PTC or PTP - but those are personal choices.

You could tape a for sale sign and walk around, etc... as long as the gun show staff allows you to do so. This is a pretty common sight at the shows up here near the Twin Cities.

I also bring a small light to look in barrels, etc... otherwise that's about it.

Good luck!

Sounds like you kinda already have the idea. Just use common sense, don't lay your jacket and gun case on top of a table holders merchandise while you show someone your gun etc.

I bought my first gun from 'The guy in the blue jumpsuit' at the St. Paul Rivercenter gun show about 9 years ago.

Question: Do any gun shows (here in MN or other states) just have a 'Traders Table'....a regular cafeteria table w/ folding chairs for trades / sales ?

No harm there and it would be under the heading: 'protect your rights by exercising them'

Got a PM that questions the need for a state issued permit to purchase for face to face sales of hand guns. Spent an hour looking through the maze of words that restrict the right to keep and bear arms here, and reach no conclusion. It ain't good when something so critical needs interpretation.

https://www.revisor.mn.gov/statutes/?id ... 624.7132.1

Subd. 12.Exclusions. Except as otherwise provided in section 609.66, subdivision 1f, this section shall not apply to transfers of antique firearms as curiosities or for their historical significance or value, transfers to or between federally licensed firearms dealers, transfers by order of court, involuntary transfers, transfers at death or the following transfers:
(1) a transfer by a person other than a federally licensed firearms dealer;
(2) a loan to a prospective transferee if the loan is intended for a period of no more than one day;
(3) the delivery of a pistol or semiautomatic military-style assault weapon to a person for the purpose of repair, reconditioning or remodeling;
(4) a loan by a teacher to a student in a course designed to teach marksmanship or safety with a pistol and approved by the commissioner of natural resources;
(5) a loan between persons at a firearms collectors exhibition;
(6) a loan between persons lawfully engaged in hunting or target shooting if the loan is intended for a period of no more than 12 hours;
(7) a loan between law enforcement officers who have the power to make arrests other than citizen arrests; and
(8) a loan between employees or between the employer and an employee in a business if the employee is required to carry a pistol or semiautomatic military-style assault weapon by reason of employment and is the holder of a valid permit to carry a pistol.

For now, I think I'll CMA by requiring either a PTC or PTP for sales / trades. This is just for conversation to gain better understanding.

There is no legal requirement for you to require a PTC or PTP in a private sale to transfer a handgun or "assault weapon" to another private seller in Minnesota.

No free tables at any show I have been to, if there were such a thing why would anyone pay for a table??

Did I miss that conclusion in state statute, or is it assumed that as long as it isn't specifically prohibited , it is permissible?

MN 624.7132 does not apply to a transfer by a person other than a federally licensed firearms dealer (MN 624.7132 Subd 12 (1)) -- and since the behavior is not prohibited, it is therefore legal.

Something that could be done on the 'Honor System' and not abused...casual sale of 1 or 2 guns.

It's a right and it could be exercised right out in public...not half-assed-ly by walking around with a sign. :)

Very good idea. Because while the law doesn't require a PTC or PTP for a private sale, it opens you up to some serious liability if you don't.

Minn. Stat. 609.66
Subd. 1f.Gross misdemeanor; transferring firearm without background check.

A person, other than a federally licensed firearms dealer, who transfers a pistol or semiautomatic military-style assault weapon to another without complying with the transfer requirements of section 624.7132, is guilty of a gross misdemeanor if the transferee possesses or uses the weapon within one year after the transfer in furtherance of a felony crime of violence, and if:

(1) the transferee was prohibited from possessing the weapon under section 624.713 at the time of the transfer; or

(2) it was reasonably foreseeable at the time of the transfer that the transferee was likely to use or possess the weapon in furtherance of a felony crime of violence.

S'pose they wouldn't put a sign with "loophole" over the table, would they... ;)

Whoa. Thanks for pointing that out to me. Seems a "half truth" was offered as "whole truth" a few posts back. Minnesota really is unique in it's wording and structure of it's statutes compared to other states where there isn't much to restrict the right to keep and bear arms. Thanks again for clarifying the consequences.

On something this critical, maybe responses could be limited to those who really know, AND of high enough moral standards that they are above common deception.

Read the whole statute and the related laws which are hot linked for your convenience on the revisor.mn.gov site. If you would have bothered to read 624.7132, you would have read this near the end:
624.7132 REPORT OF TRANSFER.

I could see 'arrow signs' at the Coliseum 'This way to the gun-show-loophole' :)
