Can wife carry a handgun that I bought?

Postby brauchma on Thu Jan 24, 2013 7:28 pm

My wife is waiting for her renewal class and needs a better gun to carry. Can I buy it when we find it? She can't right now. Just curious if there are any legal ramifications if she were to use it in a self defense situation after she renews and is carrying again.

If she is a prohibited person, then yes, it would be illegal for her to carry it. Sounds like she isn't if she has a current permit and is renewing it.

Is her permit expired? If so, then no...

if you are asking if you can buy the gun and let her use it.......yes if she is legal to possess. You can buy it and gift it to her. Sounds like your question is concerning registered owner........ registration is non existent in MN

Why can't she? That's what makes all the difference.

If it's just that she can't afford it, or that she doesn't have a purchase permit, and she's otherwise legal to possess, then certainly. There's nothing in the law that says you can't loan her your gun, or gift her with your gun, or sell her your gun.

At the moment. Turning these sorts of ordinary transactions into felonies is what Obama and Biden and their Congressional partners in crime mean, when they talk about "universal background checks."

When you are married, the items you own fall under joint property. Unless you are getting divorced, they can't have one's spouse not have access to something unless they are prohibited by law to possess something. So when you are married, you don't have to technically gift anything as what you buy is also under your spouse's ownership.

If that spouse is prohibited from owning certain items, the item must be locked away and the combination/key to the lock must not be shared.

She can legally possess a gun. She is also a better shot than me unless she gets a hot brass down her shirt in the summer. =]

Her permit expired(didn't carry much anyways) and she is taking her renewal class in early February. She actually asked me this question because she is waiting for a shield but is sad she can't find one for less than $700. She likes the feel of a Kahr PM9 and how it would conceal. We can find those easier. Found one that I can get and I thought I would ask. She wants to carry as full time as she can to protect herself and out 2 kids when I am not around.

In was just concerned on the legal aspect if she had to use it and it was in my name.

No, they don't get thrown away. The FFL is obligated to hold them. If there ever was a trace of a gun( example:found at a crime scene) There would be contact made to the mfg/ importer, then who they sold to, etc, until it got to the transferring FFL, which would provide who the gun was transferred to. That person would likely be contacted by Law Enforcement, and questioned about the gun. Until all that happens, the info is tucked away in a bound book, likely in a safe somewhere in the FFLs place of business.
