1) I agree. It 's an is-ought issue. That is how it OUGHT to be, but this is how it IS.
2) I agree they are violating your rights based on the statute and what you said here.
3) I agree that legally you are in the right and they are in the wrong, but the question now becomes what are you going to do about it? Sue them?
Let's say you do sue them for violating your rights, you win the case, and they overnight your PTP to you, all good, right? You won the case, made a legal and principled point too. All good.
Now you'll need to sue them for the legal fees and any related expenses to that lawsuit case so you can recover any monies you've spent to win your PTP; and you'll also want to sue them for the same costs you'll incur in the current case suing them for the previous case. Now you may win some, none, or all legal fees, expenses, etc.In the end, even if you "win", you still lose time and effort, neither of which can be replaced for ANY amount of money.
Let's say you win all the money back, every last cent and you break even money-wise, there's still the time, stress, and effort, that still can''t be replaced. If you don't win any money back or only some money back, then you will have paid for a PTP, something no one does, so you won in one way, but you lost in another. It just doesn't make sense to spend a dollar to make a nickel.
I'm not saying don't fight, hey, it's your money. I wish I was your lawyer (or a lawyer) because I'd be rolling in the bucks get paid on both ends for this one. I'm saying wait it out, pick your battles wisely, etc. The only real winners in this case (or any case) is the lawyers.

Lawyers are the epitome of the saying "Don't dig for gold, sell the pick axe." because whether the miner strikes gold or not, the seller of the axe still got paid.
I feel for anyone who is going through this, believe me, I'm not cold, heartless or blind to the injustice of it all, but that's why I said, pick your battles.
