Yes, it is called: Regulatory taking

There is a grey area with the 5th amendment, Imminent Domain has caused a ruckus with this. The government can lowball you big time.


Everything I can find on "Regulatory Taking" deals with land. I don't see how they can confiscate magazines without compensation.

I have at least a thousand dollars invested in magazines. If the seven-round law were passed, every single one of my magazines would be rendered illegal. My lowest capacity magazines are eight-rounders for my G38.

So voodoo you are saying that the house will pass it, but if it fails in the senate, it really wont get enough steam to get much further? Please excuse my ignorance but i am about the least political person out there, and have only what i remember from high school civics, which was 7 or 8 years ago.

They cannot "take" your magazines. They can outlaw them here in the state. If they do not offer any form of "Grandfathering" for those of us who possess several magazines, each one would be one count of said crime. So if you have 20 30rd magazines, you would be looking at 20 counts of a gross misdemeanor or however the severity would be set. They can write confiscation or forfeiture laws about anything. Hence, when you get your 3rd DWI they can and do a forfeiture on your vehicle. Or if the DNR finds to many fishes in the live well, say goodbye to your boat, truck, and trailer. If the DNR find to many fishes in your freezer, say goodbye to your house and everything in it.

The DNR has the "loosest" regulations to what it can and can do on private property. Do not ever forget that.

Yeah, I don't think it will get to the Governors desk via the Senate. There are too many State Senators that value their seats in the Capital.

I read in one of the posts where people reprinted responses from their legislators where one of them said something along the lines of "all of these bills are going to be laid over and combined into an omnibus 'Gun Violence Prevention Act' bill. That means they would cherry-pick the pieces and build a combo bill from it and vote on it all at once. I have no idea if this is actually the case, but that's what one rep said in their response. As to when that would happen, who knows. Politics is a slippery game of chess played by weasels.

Hearings this week Tuesday through Thirsdsy. In about 2-3 weeks, committee will hear an omnibus bill and vote on it. It has a strong chance of passing the committee.

From there it's on to the floor for a fight there.

We will also see senate hearings and votes at some point...

This is going to be a longish fight....

Thank you for contacting me regarding recent proposed gun control legislation. I agree that these are very important issues to many Minnesotans.

Below I have provided a schedule of upcoming hearings related to bills that involve gun control and ownership. These meetings are located in Room 10 of the State Office Building near the Capitol Complex and will begin at 10:00 am. Agenda: Bills related to Gun Violence Prevention Act.
Public testimony welcome. All testimony must be regarding a specific bill.
HF237 (Paymar) Pistols and semiautomatic military-style assault weapon transfer and firearm possession eligibility provisions modified, and criminal penalties provided.
HF240 (Schoen) Mental health screening improved for persons applying for firearm permits.
HF184 (Winkler) Centralized register of individuals who voluntarily wish to be ineligible to purchase firearms for a self-determined period of time maintenance and creation required; acceptance of voluntary surrender of firearms and ammunition from persons on the voluntary register and establishment of procedures for return of the firearms and ammunition upon request by chiefs of police and sheriffs mandated.
HF244 (Johnson) Firearm loss or theft false report crime established, crime of transferring firearms to an ineligible person expanded, and a person convicted of these crimes made ineligible to possess a firearm.
HF238 (Davnie) Offenders who unlawfully possess firearms on school properties equal penalties established.
HF239 (Davnie) Persons who possess guns on private property after being ordered to leave the premises equal penalties established.

WEDNESDAY, February 6, 2013
Agenda:
HF241 (Hausman) Assault weapons; crime established for manufacturing, transferring, or possessing assault weapons; existing assault weapon disposal or registration provided for; terms defined; data classified; language clarified; and penalties provided.
HF242 (Hausman) Large-capacity magazine crime established for the manufacture, transfer, or possession of ammunition feeding devices with the capacity to accept more than ten rounds or any conversion kit, part, or combination of parts; terms defined; and criminal penalties provided.

THURSDAY, February 7, 2013
Agenda: Specific bills TBA.

I'm looking at taking a vacation day and heading to the capital Thursday. I lived in MN most of my life, but now live in WI. Does this preclude them from taking my spoken or written testimony?

I attended the 6 PM hearing this evening. Overflow crowd with the majority sporting pro firearm attitudes. Good representation from those supporting the bills as well. Very respectful process and comments from both sides.

The bill writing is far from over so plenty of opportunities to give input and support the idea that these proposed laws are not solving the real problem.

Stay involved in the process!
