You are liable for one year, unless you do a background check. You can do a background check by seeing a PTP, a PTC, or submitting a report to the police chief or sheriff.
Even with a background check or a PTP/PTC, a seller may be liable if they knew or should have known that the gun was going to be used in a felony crime of violence. A perfect example would be you selling a gun to your next door neighbor who tells you that she's "afraid of an ex-boyfriend." Then she kills him with it.
