Pregnant Mom Arrested in New York for Unloaded Handgun in Checked Baggage

A Minnesota mom six months pregnant getting ready to head home from a trip to New York with her 6-year-old daughter was arrested last week for an unloaded handgun she had in the luggage she was attempting to check. According to WDAY, Beth Arneson Ferrizzi had no trouble transporting the gun from her departure city — Fargo, North Dakota — as she called Delta to make sure she was following the correct protocol. But she encountered problems as she tried to return home out of La Guardia International Airport, after a trip meeting her husband while he was on leave from Honduras where he is stationed for a year as master sergeant serving in the Air Force.

I for one will NEVER travel to NY (state or city). All those in against this criminal behavior by those in charge should boycott all travel. Not sure if it would make a rats a## bit of difference or not though.

To my knowledge NY is along the same path as detroit, just at a much earlier stage and slower progression. I'm hopeful to see an egress of businesses from NYC in the coming years.

Now charged with a felony, NY.'s way of taking away gun rights, one person at a time.
To bad we can't fence off NY., the criminals are already there, jest add to them. Like that old movie.

This comes to mind since she IS travelling THROUGH NY.

Notwithstanding any other provision of any law or any rule or regulation of a State or any political subdivision thereof, any person who is not otherwise prohibited by this chapter from transporting, shipping, or receiving a firearm shall be entitled to transport a firearm for any lawful purpose from any place where he may lawfully possess and carry such firearm to any other place where he may lawfully possess and carry such firearm if, during such transportation the firearm is unloaded, and neither the firearm nor any ammunition being transported is readily accessible or is directly accessible from the passenger compartment of such transporting vehicle: Provided, That in the case of a vehicle without a compartment separate from the driver’s compartment the firearm or ammunition shall be contained in a locked container other than the glove compartment or console.

True, but the article noted this is a common occurance which leads me to believe that there is NY Southern District or 2nd Circuit case law which makes this provision moot.

Maybe this will turn into a landmark case for 2A in NY, but I doubt it.

There doesn't need to be case law. She spent at least one night there in a reunion with her husband which meant she was in possession of an unregistered hand gun (un permitted gun) for NY thus voiding 926a as a defense since she could not legally possess it there.

FOPA doesn't apply. But I think that a solid case can be made that NY's FOID requirement is unconstitutional.

Which doesn't mean that such a case can be won, right now.
