Illinois lawmakers approve concealed carry gun bill

SPRINGFIELD --- State lawmakers today approved compromise legislation to set up rules on who can carry concealed guns and where they can be carried.

Illinois is the last state in the nation not to have some form of concealed carry on the books, but a federal appeals court overturned the state’s long standing ban in December and gave lawmakers until June 9 to come up with regulations to allow it.

"Don't let your constituents go off the cliff, this is a historic day for law abiding gun owners in this state," said sponsoring Rep. Brandon Phelps, D-Harrisburg.

I never thought the day would come. Even with the court order, I'm surprised they got it passed. I spent most of my life in IL, so I guess I'm just skeptical.
Real knowledge is to know the extent of one's ignorance.

It passed by a veto-proof majority, but this is the land of Chicago politics. I'm sure that there are games left to play.

Suppose, for example, that they go back to the court and ask for an extension for the stay, until the law can be signed and implemented.

And then the governor waits 60 days then vetoes it, which would send it back to the legislature. That it originally passed with enough votes to override a veto does not mean that everyone who voted for it would vote to override. Or that that no one will use the time to push through an amendment that would make it effectively may-issue, at least for Chicago.

Still, I think that the pro-rights groups in IL can hold the line on these sorts of games, if they stick together.

'Illinois carry permit' does sound a little like science fiction, but 30 years ago I'd have never believed Minnesota would do it either.

Yep they do :roll: Surprised they didnt allow ammo to be carried at the same time :P

I skimmed through the law. No reciprocity provisions but does allow non-resident applications. Lots of off-limit places that make it pretty worthless for tourists, such as all public transportation.

There is this part which is very helpful for those of us who travel through Illinois:

5 (e) Nothing in this Act shall prohibit a non-resident from
6 transporting a concealed firearm within his or her vehicle in
7 Illinois, if the concealed firearm remains within his or her
8 vehicle and the non-resident:
9 (1) is not prohibited from owning or possessing a
10 firearm under federal law;
11 (2) is eligible to carry a firearm in public under the
12 laws of his or her state or territory of residence; and
13 (3) is not in possession of a license under this Act.
14 If the non-resident leaves his or her vehicle unattended,
15 he or she shall store the firearm within a locked vehicle or
16 locked container within the vehicle in accordance with
17 subsection (b) of Section 65 of this Act.


Otherwise, not anywhere near as nice a law as we have.

Try reading it like this:
If the non-resident leaves his or her vehicle unattended,

Then
he or she shall store the firearm within a locked vehicle or
locked container within the vehicle in accordance with
subsection (b) of Section 65 of this Act.

One snip and "that" LOCKED BOX IS GONE. 10 seconds later & it's open. Cheapest dang box I've ever seen for 40 f--n $ :shock:

I forgot to mention one other advantage of the new law: no preemption. Local laws like Chicago's magazine limit are no longer allowed.

Code: Select all
Section 90. Preemption.
3          The regulation, licensing, possession, registration, and
4      transportation of concealed handguns and ammunition for
5      concealed handguns by licensees are exclusive powers and
6      functions of the State. Any ordinance or regulation, or portion
7      thereof, enacted on or before the effective date of this Act
8      that purports to impose regulations or restrictions on
9      licensees or concealed handguns and ammunition for concealed
10      handguns in a manner inconsistent with this Act shall be
11      invalid in its application to licensees under this Act on the
12      effective date of this Act. This Section is a denial and
13      limitation of home rule powers and functions under subsection
14      (h) of Section 6 of Article VII of the Illinois Constitution.


Note that the word "concealed" was striken from this as part of another amendment, 7 I believe, which means no preemption on all handguns.

I am not sure how any of this changes/relates to their FOID requirements for posession, but it would seem reasonable to me that you could lock your firearm and bring the lock box into your hotel room. Obviously, do not take this as legal advice and we'll have to see how everything shakes out. Remember, the governor has not even signed this yet so it is not in effect yet.
