Back in Nov-Jan when they were getting hammered, anyone that normally would get sent to an examiner for 'further review' during a NICS check,
automatically got delayed. They sent out an email to dealers saying they were so overloaded they simply couldn't handle the # of requests for review.
They delayed them and tried their best to even get them cleared within the 3 day window.
The 3 day wait period is '3 full business days' after the delay.
If you get delayed on a Thursday the gun 'may be' legally transferred on the following Wednesday, provided Monday isn't a holiday. Dealer isn't required to transfer.
Most delays are cleared up within a day or two.
Delays are the result of criminal history - Either the buyer or someone else with the same or similar name.
SS # doesn't always help, but often does.
When we do a NICS check, if there's anything that shows up, the phone call or echeck is transferred to an examiner.
The examiner can see criminal history. The first person to enter the buyers info from the dealer does not see criminal history.
It's then up to the examiner to go through sometimes pages of history and names and try to sort things out.
They often clear them up with a Proceed but sometimes can't spend more than a couple minutes doing it.
Sometimes the examiner will give a proceed or a delay within 10 seconds of looking at the criminal history.
One examiner told me that they will often have multiple pages of criminal history and multiple names with the
same SS #, so then they delay it right away.
Sometimes they will see a couple DWI's from 10 years ago and be able to give a Proceed right away.
Customers who have a UPIN get a Proceed 95% of the time with me.
The NICS check only gives the type of firearm - Long gun, handgun or other.
They have no idea if it's an assault type weapon, revolver, 22 pistol, etc.
Several checks in the same week don't affect it.
Time & day can.
We get more delays on weekends when there are hundreds of gun shows going on around the country and gun shops are at their busiest
times/days.
In a nut shell, if you get delayed often and it bothers you, get a UPIN.
If you don't have a criminal record, try and keep it that way.
NICS checks take approximately 5-10 seconds after the dealer enters the information. For a 'further review' it's usually less than 2 minutes.
If the big box stores tell you it'll be 30 minutes, the person entering the info is overworked
or they just want you to do some more shopping, or both.
