Nuisance lawsuit.
The Sportsman's Guide charges are a perfect example - the charges are nothing more than pure bovine excrement, but given lawyer's fees and the amount of time they would spend fighting the charges, it's less expensive to settle out of court.

RVW hit the nail on the head. Adopt "loser pays", and this type of lawsuit ceases to exist.

I like the idea that in order to bring a suit for say $2 million you must first put your own $2 million in an account. If you lose the judge can give the entire sum or a portion of it to whomever the suit was against for their wasted time and fees. If you win you get it back plus fees and the amount the judge determines you won but it's capped at the original sum you were willing to put up.

In the country I grew up in, a lawsuit such as this would have been laughed out of court and the judge would have publicly admonished the lawyer who filed it.

We don't live in that country anymore.

In a civilized and truly just country, the judge would walk over to the lawyer and beat him unconscious with his gavel while the bailiff held him down ;)

I'm self representing myself in a lawsuit right now (because the lawyer I previously had was an idiot and I'm tight on funds). Reading up on do-it-yourself lawsuits, I ran across the tidbit that if the judge determines that the lawsuit is frivolous, not only is it dismissed, but the party bringing it on CAN be made to pay the expenses and fees of the defending party.
