At least 5 dead in West Texas shooting after traffic stop
AUSTIN, Texas (AP) — At least five people were dead in West Texas after a man who was stopped by state troopers when his vehicle failed to signal a left turn opened fire and fled, shooting more than 20 people before he was killed by officers outside a movie theater, authorities said Saturday. Three law enforcement officers were among the injured.

The shooting began with an interstate traffic stop in the heart of Texas oil country where gunfire was exchanged with police, setting off a chaotic afternoon during which the suspect hijacked a U.S. Postal Service vehicle and began firing at random in the area of Odessa and Midland, hitting multiple people. Cell phone video showed people running out of a movie theater, and as Odessa television station KOSA aired breaking developments on live TV, their broadcast was interrupted by police telling them they had to clear the area.

The Latest: FBI: Gunman troubled before job woes, shooting
Odessa Police Chief Michael Gerke said Monday that 36-year-old Seth Aaron Ator had been fired over the weekend from Journey Oilfield Services. He said both Ator and the company called 911 after being fired Saturday but that Ator was gone by the time police showed up. FBI special agent Christopher Combs says Ator’s statements on the FBI tip line were “rambling.”

A better headline might be "Gunman called FBI and 911 just before rampage".

Texas gunman who killed seven had previously failed background check for firearm
(Reuters) - The gunman who killed seven people and wounded 23 others in a rolling rampage across West Texas obtained an assault-style rifle despite failing a background check, state and law enforcement officials said on Monday.

The gunman, identified by police as Seth Aaron Ator, 36, carried out the shooting spree in the neighboring cities of Midland and Odessa on Saturday, a short time after he was fired from his trucking job. He called local emergency 911 responders and then an FBI tip line to make rambling statements, officials said.

Lott may be a good author and know a lot about gun stats/issues but he sure doesn't impress in interviews...

Texas Shooter Had Been Banned From Buying Firearms Because Mentally Unfit
A man who went on a deadly mass shooting spree across West Texas on Saturday was barred under federal law from owning or buying firearms because a court had previously determined he was mentally unfit, according to law-enforcement officials.

Authorities on Tuesday were looking into whether the gunman, 36-year-old Seth Aaron Ator, bought the AR-15 style rifle used in the attack through a private sale, thus avoiding a background check, the officials said.

The gunman had tried to buy a gun in January 2014 but failed because a nationwide criminal background check system flagged the mental health determination by a local court and prevented the purchase, according to the officials.

No but it would have made his illegal acts due to his illegal behavior illegal.

Authorities Suspect Man of Making and Selling Gun Used in Texas Shooting
Authorities suspect the Lubbock man sold Ator the gun through a private sale. Such a sale allowed Ator to purchase a gun without going through a criminal-background check. Gun-control proponents have frequently complained that private sales are a hole in the background-check system that should be addressed.

It is unclear whether the man knew Ator was a prohibited person when selling him the rifle. If the gun dealer did in fact know that Ator was barred from buying guns, he could be charged with a federal crime. But authorities are also looking into whether the man was illegally selling guns.

While private gun sales are legal under federal law, it is a crime to be in the business of manufacturing or selling guns without a license. Law-enforcement officials suspect the man was buying various gun parts to build his own guns and then reselling them.
