Nevada to open up reciprocity

Postby phorvick on Wed Sep 26, 2007 1:37 pm

The State of Nevada is about to release a list of States that they will honor. The list "should" be out on or about October 1.

According to sources at the State, Utah will be on the list of States they honor. I do not know if they will honor a non-resident Utah though.

Should be interesting....

Considering what I have been reading about the crime problem around Vegas, I think they would be better off issueing complimentary permits at the airport and have gun rental at all the car rental agencies

It found 16 other states that had an electronic database accessible 24 hours a day that identifies valid permit holders. Of those 16, only eight had concealed carry permit laws that were as stringent or more stringent than Nevada, the Department of Public Safety said.

Alaska? One of two states that doesn't require a permit? Why do I think the review list was similar to "My brother lives in Alaska, and he's coming to visit next year, so let's include that state."?

From what I've read on THR, they don't care if it's a resident permit or not.

The law doesn't specify that it must be a resident permit -- just that you can't carry on an out-of-state permit if you are a Nevada resident:

Hey...where is my thanks!

Keep in mind though that some counties (at least Clark County....the Las Vegas area) has local registration requirements that must be met. Meaning....

DO NOT carry into Nevada under your Utah Permit until you are sure of local regulations/requirements etc.

But, very good news nonetheless.

I "think" the only place that has that quirky "registration" rule is Clark County (Las Vegas).

Nevada has a "Statewide Pre-emption" law, so counties and localities cannot pass gun laws that are more stringent than the state law. Clark County (Las Vegas area) had some laws which pre-date the pre-emption (they were "grandfathered") and are still in place.

From what I understand(no direct knowledge of any kind), you have 24 hours in Clark County before you have to register, so passing through to Frontsight, for example, wouldn't be an issue, but I'd verify that before I tried it.

The registration is not a law. I've read the city ordinance and the county ordinance and in plain text it does NOT apply to anyone who is not trying to take up residence. I don't remember the full text now, but it spoke of transfers. If you move into that area, you are transferring the gun. If you sell the gun, you are transferring it. It does not say if the gun passes through or visits the area for 24hours, a week, two weeks.

I wrote a (more/less) rant about it on packing.org... too bad it's gone now... At the time, there was a group that was telling people to stand down because they've got something it the works. Nothing happened.

This registration is ... not fitting with the law they have on the books.

I'm not a lawyer. But I can read english.

Me personally, if I go there, they can kiss my ass before I register. I don't have the money, but I'll be a test case.

Here...you can read it for yourself. I am a lawyer, and I wouldn't take the risk.
---
Registration of pistols within twenty-four hours. (Clark County Code 12.04.110)
Any person receiving title to a pistol, whether by purchase, gift, or any other transfer, and whether from a dealer or from any other person, shall, within twenty-four hours of such receipt, personally appear at the county sheriff's office, together with the pistol, for the purpose of registering the same with the sheriff. It shall be the duty of the sheriff to register the pistol, and he may, and is hereby authorized to cooperate in any manner he sees fit with other law enforcement agencies, and with licensed dealers, relative to registration of pistols, so that efficient registration shall be secured at minimum cost and duplication. (Ord. 242 §§ 11, 1965)

Registration of firearms capable of being concealed. (Clark County Code 12.04.200)
It is unlawful for any person to own or have in his possession, within the unincorporated area of Clark County, a gun, pistol, revolver, or other firearm capable of being concealed, unless the same has first been registered with the sheriff or with a police department of any of the incorporated cities of Clark County. (Ord. 242 §§ 20, 1965)

Certainly, the top section agrees with it not needing to be registered ...but...then there is the bottom section...

Clear? No. But the authorities believe it needs to be registered.

Then again, concealed is concealed etc etc.

Edit to add... I have been told that "Regarding the "blue card", until the Clark County Commission complies with the provisions of S.B. 92 or 1/1/08, whichever comes first, you will still have 24 hours to register your handgun. After 1/1/08 or the CCC amends its ordinances, you'll have 30 days to register your handgun if you are a new arrival and 72 hours to register a newly acquired handgun if you are a resident."
