You cannot rely on the wording of the statute to determine the scenarios when deadly force is legally justified. You need to look to all of the case law on the subject.

I presume that no one wondering about the legalities of use of deadly force in this thread have a permit to carry. If you did, your instructor would have covered the statutes and case law that answer those questions. Even if you don't carry a gun in public, if you own one for self defense I would highly recommend taking a carry class from a competent instructor, if for no other reason to learn the law with regards to the use of deadly force.

There are so many presumptions, errors, and total nonsense in this thread it's scary. If you don't know what the law actually is, where the gray areas are, and how they apply, please get some training.

While training is a good thing, I do not think one should substitute it for actual legal advise.

If anyone wants to hire a defense attorney who specializes in firearms law, and have him go over all the case law and it's meanings, all the better! Most people aren't going to do that though. Taking a carry class from a competent instructor, certified to teach the law regarding use of deadly force should be a minimum for anyone who owns a firearm for personal defense.

Agreed. There are many good instructors and many are on this very forum. That said, certification does not ensure a top quality product, rather a product that meets a standard and based on personal experience, that level of quality can vary quite a bit in what is still in this state a fairly young profession. Any legal advise one gets from a class really should be vetted through additional sources before using it as the basis of ones decision making.

I would add that not all instructors do a great job of laying out the scenarios or explaining the meaning of the law and how it applys to common situations. The quality of instruction can vary greatly.

Reminds me of a saying that was used quite frequently here years ago when someone would pose a question that was thought to be pretty rudimentary-

I appreciate reading your posts jshuberg, but I'm not aware of a place where one can check case law. And I could have the most competent instructor in the state and if case law changes after my class I'm still up a creek. Are there instructors who send out notices to students that they have taught when they become aware of case law change? If so I will want to use one of them when my renewal comes due again.

I have a permit from GA and just took the class here in MN and I can say the instructor here did not explain the laws as well as most in the class would have liked. Now in GA they don't require a class to get your permit but the group GCO does a wonderful job explaining the laws along with any updates. The website GPO which is loosely linked to GCO also has numerous people who know and explain the laws. I have mentioned to people many times in GA how I wish there was something here like that. And if any of the people here feel that most are not clear on the laws why do they not try to educate the people. Not give out legal advise but show links to establish case law on the subject of self defense. God knows that once I get a better handle on the laws for self defense I will do more to educate. If I could afford two or three hours of a lawyers time I would do it. I changed jobs so the pay cut I took will not allow it. I am going thur the laws slowly but surely.

You can read caselaw in the MN Law Library, it's public information and available on the web.

+1 on the comment about instructor quality. You get what you pay for, and a lot of people seem to want to get their permit on the cheap.

I wish them the best of luck, but consider this: when you shoot someone in self-defense, your instructor is probably going to be coming to court as a witness. You might want to consider how they will represent you, their background, and level of knowledge about the subject.

That's got to be wrong, no way is that book worth $300. Don't get me wrong, it's filled with good information, but that price is crazy.
